“Auto Services” means any repair (including parts), maintenance, diagnostic, tuner and detailing services provided by freelancers or businesses under a Booking.
“Provider” means an independent provider of Auto Services (freelancers and businesses) that provide mechanic, tuner and detailing services.
“Booking Request” means a request from you made by means of the Platform, for the supply of Auto Services.
“Booking” means the provision of Auto Services entered into between you and freelancers or businesses by means of the Platform.
“Charges” means the charges payable in respect of parts and labor under a Booking.
“Listing” means a listing on the Platform with a description of freelancers and businesses.
“Users” means you, any person who uses the Platform.
“Customer” means any person who purchases service on the Platform.
Omega Car Care is not an auto repair, maintenance, diagnosis or inspection service. It is a means for you to browse, book and pay for Auto Services from our partner Providers.
The Platform is designed to enable users to make a Booking for Auto Services with a Provider. Auto Services are provided by the Providers, and not by us. We are responsible only for listing, taking your Booking, processing payment - all on behalf of the Providers. The content of the Listing on the Platform, and the provision of the Auto Services, are entirely the responsibility of the Providers.
The Platform is used by a wide range, and a large number, of Providers - all of whom are independent contractors, not employed directly by Omega Car Care. Each Provider is responsible for the quality of their own advice and service. Omega Car Care cannot be held responsible for work completed. We display our "Top Rated" Providers only to assist customers in their choices, but we cannot endorse or be responsible for them.
The Providers are not our employees or workers. We have no involvement in the provision of the Auto Services. We require our Providers to ensure that all information provided by them in a Provider Listing is accurate and complete. We take what reasonable steps we can to ensure that the Provider has a trading history, and experience of providing Auto Services, but we cannot realistically vet all details of each Provider Listing. We are therefore not responsible for any inaccuracies in the Provider Listing.
By making a Booking Request for a particular date, you acknowledge that the Provider will begin providing the Auto Services in advance of that date. For example, he/she may hire labor, order in parts, and research aspects of your car required in order to effectively carry out the relevant repairs and diagnosis. The cancellation provisions in the Booking are intended to reflect the value of the Auto Services already provided in advance of the time of cancellation, and therefore the amount of your liability to pay to the Provider as a result of the cancellation.
You acknowledge and agree that by making a Booking Request you are authorizing us to present it to Providers for their review. If a Provider offers to fulfill the terms of the Booking Request, we will disclose to you the details of that Provider and you can either accept or reject that offer. Any such acceptance of the Provider’s offer to fulfill the Booking Request will form a binding contract under which you agree to pay for Auto Services as specified in the Booking Request.
Once you book Auto Services through the Platform in accordance with these Platform Terms, payment will be pre-authorized for it by or on behalf of the Provider. At the point that payment is made to the Provider on completion of the Auto Services, your payment obligation to the Provider in connection with the Auto Services is released.
As a consumer, you will have legal rights against the Provider in relation to any Auto Services that is not provided in accordance with reasonable skill and care, or if the Auto Services is not as described in the Booking (including any changes to the Booking agreed between you and the Provider). Nothing in these Platform Terms will affect your legal rights.
In the event that a Provider with whom you have made a Booking no longer has a current registration with the Platform, we will notify you.
Omega Car Care uses a third party payment processor – Stripe and PayPal to validate credit and debit cards and process payments. Omega Car Care does not directly receive or store your credit or debit card information. When you schedule a Job, you will be asked to authorize a charge to your card upon completion of booking the Job for the amount of the quote you accepted on the website for the Job you want performed. Upon completion of the Job, your debit or credit card will be charged for the amount specified, as well any applicable sales tax, if any. Although your credit or debit card provider may give you notice of the authorized charge, your card will not be charged, and no funds will be transferred to Omega Car Care, until the Job is completed.
We provide a Limited Warranty for work performed through the Service. For most maintenance and repair work provided through the Service the length of the Limited Warranty is 12 months or 12,000 miles, whichever occurs first. For oil changes the length of the warranty is 90 days or 3,000 miles whichever occurs first. The terms and conditions of our Limited Warranty are available at omegacarcare.com/limited-warranty. We may change the Limited Warranty from time to time, with any changes effective for Jobs scheduled after such changes are posted to the Site.
Omega Car Care has a 24-hour cancellation policy. We charge a $ cancellation fee for the following reasons:
If you cancel your appointment within 24 hours.
You or your vehicle are not available when we arrive.
Additionally, you will be charged a minimum 1-hour labor charge if:
You decline service after work has begun.
The issue resolved itself and is unable to be reproduced.
Your vehicle is ineligible for service and you booked it anyway, including:
Damaged and require a body shop to repair
Disassembled by you or another shop
Modified from the factory
Failed an emissions test or need an emissions test
Occasionally, situations happen where a provider is unable to make the appointment due to circumstances outside of their control. When this occurs, a service advisor will reach out to let you know and provide options for rescheduling your appointment. You will not be charged a cancellation fee if Omega Car Care needs to change your appointment time.
Omega Car Care encourage our Freelancers and Customers to try and resolve any disagreement between themselves. However, should that not be possible Omega Car Care Customer Service can provide Dispute resolution.
Omega Car Care grants you a 48-hour window to dispute the results. Just provide us with some compelling visual evidence (video, photo), and we'll dive into detective mode, examining your dispute with the utmost dedication. The clock starts ticking as soon as the job is done.
If one party wants to dispute the work/fee for any reason, then can submit a dispute. We ask both parties to comment (explaining the issue) and we make a final decision on the amount to be refunded, if any.
In case a reduced payment is agreed between the Freelancer and Customer, we will credit the Freelancer’s account with the amount agreed and then credit the Customer’s account with the remainder of the balance that was taken when the booking was made, minus the booking fee.
Whilst you are in compliance with these Terms, we grant you a non-exclusive, non-transferable, personal, revocable limited license to access and use the Platform for your own personal, private or (if you are a business) internal business use, in each case provided that such use is in accordance with these Terms. You agree not to use the Platform, or any content of our Website, for anything else.
We have the right to suspend, withdraw or modify the Platform (in whole or in part) without liability to you at any time, including in the following circumstances: for technical reasons (such as maintenance, or technical difficulties experienced by us or on the internet); to allow us to improve the usability of functionality of the Platform; where we have legal reasons for doing so (including privacy or other legal objections to the content or functionality of the Platform); because it is no longer economically viable or efficient to provide the Platform.
If you set up a user account with us, you agree that you shall take all steps necessary to protect your login details and keep them secret. You agree that you shall not give your login details to anyone else or allow anyone else to use your log in details or account.
If you fail to keep your login details confidential, or if you deliberately or unintentionally share your login details or account with someone else, you accept full responsibility for the consequences of this and agree to fully compensate us for any losses or harm that may result.
We will not be responsible to you for any loss that you suffer as a result of an unauthorized person accessing your account and using the Platform and we accept no responsibility for any losses or harm resulting from its unauthorized use, whether fraudulently or otherwise.
If you notice an unauthorized use or breach of your user account, you must notify us immediately at support@omegacarcare.com.
We reserve the right to suspend or terminate your access to the Platform (including by deleting your account) at any time. We will likely do so if we reasonably believe that you are in breach of these Terms.
You agree to compensate us, according to law, for all losses, harm, claims and expenses that may arise from any breach of these Terms by you.
You acknowledge that all copyright, trademarks (including ‘Omega Car Care’ and the Omega Car Care logo), and other intellectual property rights in and relating to the Platform (other than the content of Provider Listings and Auto Services, which remain the property of the Provider) are owned by us or licensed to us by our partners.
You must not copy, distribute, make available to the public or create any derivative work from the Platform or any part of the Platform unless we have first agreed to this in writing. You must not use any of our trademarks (including the ‘Omega Car Care’ and the Omega Car Care logo), or other intellectual property rights in and relating to the Platform without our prior written consent.
If you submit comments, ideas, or feedback to us, you agree that we can use them without any restriction or compensation to you. If we accept your submission, we do not waive any rights to use similar or related ideas or feedback previously known to us, developed by our employees, or obtained from sources other than you.
We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. You must not use any part of the content on our site for commercial purposes without obtaining a license to do so from us or our licensors. If you print off, copy or download any part of our site in breach of these terms, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
If you have a complaint about any of the Providers Listed, you can rate them and leave public feedback or notify us by emailing support@omegacarcare.com with the following information: name; street address; email address; full details of your complaint and the Provider Listing (or Provider Listings) you are complaining about. These requests should only be submitted by you or someone who is authorized to act on your behalf.
We may link to third party products or services from the Platform, including to Providers’ websites. You understand that we make no promises regarding any content, goods or services provided by such Providers or other third parties. We are also not responsible to you in relation to any losses or harm caused by such third parties. You understand that when you provide data to such third parties you are providing it in accordance with their privacy policy (if any) and our own Privacy Notice does not apply in relation to that data.
Entire Agreement
These Terms (and any additional terms, contracts, rules, and conditions that Omega Car Care may post on the Platform) and the Privacy Policy constitute the entire agreement between you and Omega Car Care with respect to the Platform and supersede any prior agreements, oral or written, between you and Omega Car Care.
Waiver and Severability
If any provision(s) of the Terms is held by an arbitrator or court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties and the other provisions shall remain in full force and effect. Omega Car Care’s failure to exercise or enforce any of the Terms shall not constitute a waiver of Omega Car Care’s right to exercise or enforce the Terms as to the same or another instance.
No Third-Party Beneficiaries
You agree that, except as otherwise expressly provided in these Terms, there shall be no third-party beneficiaries to these Terms.
Force Majeure
Omega Car Care shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, war, terrorism, riots, embargos, acts of civil or military authorities, fire, floods, accidents, strikes or shortages of transportation facilities, fuel, energy, labor or materials.
